Terms of Service

These terms govern your access to and use of Tallwatch's monitoring services, dashboards, and APIs. By creating an account you agree to them. See Section 5 for our complete Refund Policy.
1. Acceptance of terms
By accessing or using Tallwatch (the "Service") you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
2. Accounts and eligibility
You must provide accurate information when registering and keep your credentials secure. You are responsible for all activity under your account. You must be at least the age of majority in your jurisdiction to use the Service.
3. Acceptable use
You agree not to:
- Monitor endpoints you do not own or have explicit permission to probe.
- Use the Service to launch denial-of-service attacks or to circumvent rate limits.
- Reverse engineer, resell, or sublicense the Service except as permitted in writing.
- Upload unlawful content or infringe the rights of any third party.
4. Plans, billing, and trials
Paid plans are billed in advance on a monthly or annual basis. We may change pricing with at least 30 days' written notice. Price changes do not apply retroactively to your current billing period.
Free tiers are provided under a public, dated policy and may change with notice, but we will not retroactively remove access you currently depend on without warning.
Trials, where offered, automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. You will be notified before conversion.
5. Refund Policy
We want you to be satisfied with the Service. This section defines the complete scope of our refund policy:
- Monthly plans: if you cancel within the first 7 days of your initial subscription, you are entitled to a full refund. After 7 days, cancellation stops future billing but the current period is non-refundable and you retain access until its end.
- Annual plans: if you cancel within the first 14 days of your initial subscription, you are entitled to a full refund. After 14 days, cancellation stops future renewal but the remaining term is non-refundable and you retain access until the period ends.
- Plan upgrades: prorated credit from your previous plan is applied to the new plan. Downgrades take effect at the next billing cycle with no retroactive refund for the current period.
- Service outages: if Tallwatch fails to meet its published SLA for your plan tier in a given month, you may request a prorated credit for the affected period.
- Duplicate charges: accidental duplicate payments will be refunded in full within 5–10 business days of confirmation.
- Trial-to-paid conversion: if you were charged after a trial ended and you intended to cancel, contact us within 7 days of the charge for a full refund.
To request a refund, contact billing@tallwatch.com with your account email and the reason for your request. Refunds are processed via the original payment method (Stripe) and typically appear within 5–10 business days. All refund requests are evaluated fairly and in compliance with applicable consumer-protection laws.
6. Service availability
We work hard to keep the Service reliable, but it is provided on an "as available" basis. Monitoring is a best-effort signal and should not be your only safeguard against downtime. Any committed uptime targets, if applicable, are stated in a separate service-level agreement.
7. Your data
You retain ownership of the data you submit. You grant us a limited license to process it solely to operate and improve the Service. Our handling of personal data is described in our Privacy Policy.
8. Intellectual property
The Service, including its software, design, and trademarks, is owned by Tallwatch and its licensors. These terms do not grant you any right to our branding except as needed to use the Service normally.
9. Termination
You may cancel at any time from your account settings. We may suspend or terminate access for breach of these terms, for risk to the Service, or as required by law.
On termination, your right to use the Service stops and your data will be retained for 90 days to allow for reactivation, after which it will be permanently deleted. You may request an export of your data before termination takes effect.
10. Disclaimers and liability
To the maximum extent permitted by law, the Service is provided without warranties of any kind, and our aggregate liability is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential damages, including losses arising from missed or delayed alerts.
11. Changes to these terms
We may update these terms from time to time. Material changes will be communicated through the Service or by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
